1. Introduction

These Terms of Service ("Terms") govern your use of the Harker application ("Harker" or "the Software") and related services provided by Ourfires Ltd ("we," "us," or "our"). By downloading, installing, or using Harker, you agree to be bound by these Terms.

2. Description of Service

Harker is a voice-to-text transcription application that runs locally on your device. When activated by a keyboard shortcut, Harker listens to your voice input and converts it to text using AI transcription models, then pastes the transcribed text into your active text field.

  • Multiple AI transcription models (Whisper-based)
  • Customisable keyboard shortcuts

3. Service Tiers

3.1 Free Tier

Harker is available as a free download with core transcription features. The Free tier includes:

  • Unlimited local voice-to-text transcription
  • Multiple Whisper model options
  • Customisable keyboard shortcuts
  • No account required

3.2 Premium Tier

Harker Premium is a paid subscription that unlocks additional AI-powered features, including but not limited to:

  • AI text transformation (formatting, summarisation, rephrasing)
  • Additional premium features as they are released

Premium features require an active subscription and a Harker account.

4. Account Registration

4.1 Account Creation

To access Premium features, you must create an account using a valid email address. We use magic link authentication — no password is required.

4.2 Account Responsibility

You are responsible for maintaining the security of your email account and any devices where you are signed in to Harker.

5. Subscription and Payment

5.1 Subscription Plans

Harker Premium is available as a monthly or annual subscription. Current pricing is displayed on our website at getharker.com/pricing.

5.2 Payment Processing

Payments are processed securely through Stripe. We do not store or have access to your payment card information.

5.3 Billing Cycle

  • Monthly: Billed on the same date each month from the date of purchase.
  • Annual: Billed on the same date each year from the date of purchase.

Your subscription will automatically renew at the end of each billing cycle unless cancelled.

5.4 Price Changes

We reserve the right to change subscription pricing. Any price changes will be communicated in advance and will take effect at the start of your next billing cycle.

6. Cancellation and Refunds

6.1 Cancellation

You may cancel your Premium subscription at any time through your account settings or by contacting support. Upon cancellation:

  • You retain access to Premium features until the end of your current billing period.
  • Your subscription will not renew.
  • You can continue using the Free tier after your subscription ends.

6.2 Refund Policy

We offer refunds within 14 days of your initial purchase or renewal if you are not satisfied, subject to the following conditions:

  • You must provide a reasonable explanation for the refund request

6.3 Processing Time

Approved refunds will be processed within 5–10 business days to your original payment method.

7. License and Ownership

7.1 License Grant

Subject to your compliance with these Terms, we grant you a non-exclusive, non-transferable, revocable licence to use Harker for your personal or business purposes.

7.2 Ownership

Harker and all related intellectual property rights remain the exclusive property of Ourfires Ltd. This licence does not grant you any ownership rights in the Software.

7.3 Restrictions

You may not:

  • Reverse engineer, decompile, or disassemble the Software
  • Distribute, sell, lease, or sublicence the Software
  • Remove or modify any proprietary notices or labels
  • Use the Software to create competing products
  • Share your Premium account credentials with others
  • Circumvent subscription verification or access Premium features without an active subscription

8. AI Text Transformation — Acceptable Use

8.1 Permitted Use

AI text transformation features are provided for legitimate personal and professional use, including formatting, summarising, and rephrasing your own dictated text.

8.2 Prohibited Use

You may not use AI text transformation features to:

  • Generate content that is illegal, harmful, threatening, abusive, or harassing
  • Produce content that infringes on the intellectual property rights of others
  • Create misleading or fraudulent content
  • Circumvent content moderation or safety systems
  • Process content in volumes that constitute abuse of the service (automated or scripted bulk requests)

8.3 Our Rights

We reserve the right to suspend or terminate access to AI features if we determine that usage violates these Terms or applicable law.

9. System Requirements and Compatibility

9.1 Current Compatibility

  • macOS: Harker is available for Mac systems
  • Windows: Windows support is coming soon
  • Performance: Device performance significantly impacts Harker's speed and accuracy. Newer machines with more RAM will provide better performance.

9.2 No Warranty of Compatibility

We do not guarantee that Harker will be compatible with all hardware configurations or operating system versions.

10. Transcription Accuracy and AI Models

10.1 AI-Powered Transcription

Harker uses various Whisper-based AI models for voice transcription. You can download and select different models based on your needs:

  • Larger models: More accurate but require more system resources and processing time
  • Smaller models: Faster processing but may be less accurate

10.2 No Accuracy Guarantee

While we strive for high transcription accuracy, we do not guarantee perfect transcription results. Accuracy depends on factors including:

  • Audio quality and clarity
  • Background noise
  • Speaker accent and pronunciation
  • Selected AI model
  • Device performance

10.3 AI Transformation Accuracy

AI text transformations (formatting, summarisation, rephrasing) are provided on an "as is" basis. Results may not always be accurate or appropriate for your intended use.

10.4 Your Responsibility

You are responsible for reviewing and verifying all transcribed and transformed content before use.

11. Privacy and Data Processing

11.1 Local Processing

All voice processing occurs locally on your device. No voice recordings or transcribed text are transmitted to our servers or any third parties.

11.2 AI Text Processing

If you use AI transformation features, your text is sent to our servers for processing. Text is processed in real time and is not stored. See our Privacy Policy for details.

11.3 Privacy Policy

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of Harker, to understand our practices.

12. User Responsibilities

12.1 Lawful Use

You are solely responsible for ensuring your use of Harker complies with all applicable laws and regulations in your jurisdiction.

12.2 Content Responsibility

You are fully responsible for:

  • The content you choose to transcribe and transform
  • Any actions taken based on transcribed or transformed content
  • Compliance with privacy laws when transcribing conversations involving others

12.3 Device Security

You are responsible for maintaining the security of your device and protecting your Harker account from unauthorised access.

13. Support and Updates

13.1 Customer Support

Technical support is available via email at support@getharker.com. We will make reasonable efforts to respond to support requests promptly.

13.2 Software Updates

We may provide updates, patches, and improvements to Harker. Updates to the Free tier are provided at no cost. Premium feature updates require an active subscription.

14. Disclaimers and Limitations of Liability

14.1 "As Is" Basis

Harker is provided "as is" and "as available" without warranties of any kind, either express or implied.

14.2 Limitation of Liability

To the maximum extent permitted by law, Ourfires Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption.

14.3 Maximum Liability

Our total liability to you for any claims arising from your use of Harker shall not exceed the total amount you paid for Premium subscriptions in the 12 months preceding the claim.

15. Termination

15.1 Termination by You

You may stop using Harker at any time by uninstalling the Software. You may cancel your subscription and delete your account at any time.

15.2 Termination by Us

We may terminate your account or suspend your access if you breach these Terms. Upon termination, you must cease using Premium features and your subscription will not be renewed.

15.3 Effect of Termination

Upon termination, you may continue to use the Free tier of Harker. Sections that by their nature should survive termination (including ownership, liability limitations, and dispute resolution) will continue to apply.

16. Changes to Terms

16.1 Modification Rights

We reserve the right to modify these Terms at any time. We will notify users of material changes by:

  • Posting updated Terms on our website
  • Sending email notifications to account holders
  • Including notifications in the Harker application when possible

16.2 Acceptance of Changes

Your continued use of Harker after changes to these Terms constitutes your acceptance of the new Terms.

17. Governing Law and Disputes

17.1 Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.

17.2 Jurisdiction

Any disputes arising from these Terms or your use of Harker will be subject to the exclusive jurisdiction of the courts of England and Wales.

18. General Provisions

18.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ourfires Ltd regarding Harker.

18.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue to be valid and enforceable.

18.3 No Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.

18.4 Assignment

You may not assign or transfer your rights under these Terms without our written consent. We may assign our rights and obligations under these Terms without restriction.
